STATEMENT OF SHRI AJAY MAKEN ON ORDER BASSED BY HIGH COURT PROTECTING STREET VENDORS ACCROSS DELHI

Delhi Congress Chief and former Housing & Urban Poverty Alleviation Minister (HUPA) Shri Ajay Maken today approached the Delhi High Court seeking protection in cases of atrocities against Street Vendors in the National Capital.

On this Plea of Maken, a division bench of the Court headed by Chief Justice G. Rohini, directed the Delhi Police, MCD, NDMC and the Delhi Government that no Street Vendor shall be evicted in the National Capital, without following due process of law. Section 3(3) of the Street Vendors Act, 2014 mandates that no Street Vendor can be evicted till a survey is completed as per the process provided in the Act. In Delhi, no survey of vendors has been conducted yet, as the Kejriwal Government has failed to frame a Scheme, as per the Act.

“Such unlawful and arbitrary eviction of vendors by Delhi Police and Municipal Authorities is carried out in order to harass the poor hawkers and extract money from them”, said Maken in his Petition.
Before the Court, the Congress Chief also highlighted the various incidents where Vendors were not just arbitrarily removed but also harassed and beaten by Police and MCD officials. Maken also said that in the said process, the highhanded authorities also illegally destroy and take away the articles of vending of the vulnerable vendors. The Bench was told that even though the Parliament in 2014 had brought a specific legislation for the protection of Vendors in the Country, the Authorities have completely failed to implement the same. Moreover, if the Act is not implemented, the hawkers/ vendors who are currently earning their livelihood through a dignified means, will be forced into begging, stealing or other vices.

Maken’s move to approach High Court came after recent incidents wherein Vendors/ Hawkers were illegally thrown out from various parts of Delhi. Some of the incidents highlighted before the Court, are as follows:

a)         Lajpat Nagar, Main Market (Sethi Chowk) on 17.08.2016
b)         Sarojini Nagar Market on 29.07.2016
c)          Lodhi Colony, Opposite Block VII on 30.05.2016 
d)         Okhla, Harkesh Nagar Sabzi Mandi on 07.04.2016
