Land Pooling Policy was notified by the Ministry of Urban Development

Much publicized Land Pooling Policy was notified by the Ministry of Urban Development on 5th September 2013 vide S.O. No. 2687(E). The Land Pooling Policy is based on the optimum utilization of available resources, both public & private in land assembly, development & housing in J, K, L, N and P (I&II) Zones (as per MPD-2021). The land required for urban extension, will have to be assembled for planned development as per the land pooling given. According to Land Pooling Policy, the DDA will act as facilitator with minimum intervention to facilitate and speed up the integrated land development. The Developer entity shall be permitted to pool land for unified planning, servicing and sub-division / share of the land for development as prescribed under the provisions of the policy.
The Regulations for operationalization of the policy was approved on 26.05.2015 by the Ministry of Urban Development, Government of India but the policy is yet to be operationalized.  Even, the Municipal Corporation of Delhi (South Delhi Municipal Corporation & North Delhi Municipal Corporation) has passed the resolutions in their respective Houses and has sent their consents to the Govt. of NCT Delhi for further statutory approvals. The matter is lying pending with the Delhi Government for the last 17 months for declaration of 89 villages as “urban” villages and 95 villages as development areas under the provisions of the relevant rules.  DDA had sent several reminders to Delhi Government for the implementation of the Land Pooling Policy.
It is learnt that Delhi Government had requested the DDA that the land component pertaining to public and semi public use and Industrial use aggregating to 12% to 15% of such pooled land be given to Govt. of NCT Delhi on free of cost basis. The DDA has refused to accept the request of Govt. of NCT Delhi.  It is to be added that there is a provision in section 12-A of DMC Act, the Lieutenant Governor is competent to finalize the policy at his level.  
The Government of NCT Delhi and the people of Delhi may get the following advantages (if it is implemented) through this Land Pooling Policy:
Revenue
Delhi Government will get Revenue in thousands of  Crores through stamp duty etc.
Employment
Lakhs of people (skilled/unskilled) of Delhi will get employment through this project directly or indirectly.
Beneficial for farmers
Farmers will also be benefited as they will get a handsome / justified value of their land at market rate. They will also be able to participate in this policy.
Flats for EWS
Through implementation of this Land Pooling Policy,   thousands of EWS flats will be constructed & transferred (free of cost) to the residents of JJ Cluster of Delhi which will improve the life style of poor people of EWS category.
House for residents of Delhi
More than 25 lakh dwelling units will be constructed under this policy which will solve the housing problems of homeless residents of Delhi at affordable cost.
Investment
The people of Delhi have invested thousand of Crores in this project so far. The delay in non- declaration of 89 villages of Delhi as urban village and 95 villages as Development area is affecting the investors of Delhi because the construction cost/escalation price is increasing swiftly day by day.
Hospitals/Health centers/Educational institutions/ Universities
Through this land pooling policy, a large number of hospitals / community Health centers / educational institutions & Universities etc. will be established which will solve the shortage of these institutions .
Commercial
A Large number of high standard shopping complex, local markets etc. will be established and the Delhi Government / Central Government will get the revenue through taxes from these commercial activities.
The delay in implementing the policy has led to a large number of people/ investors being fleeced into making initial investment for Housing projects under the land pooling Policy. There is great resentment amongst the investors/stakeholders of the Land Pooling Policy.
This Federation of Housing Societies & Developers in Delhi (Land Pooling Policy) and Delhi Dehat Vikas Munch have given several letter/Memorandum to the Officers and Politicians of Delhi (Lieutenant Governor, DDA, Chief Minister, Deputy Chief Minister, Ministers of Govt. of NCT Delhi, Members of Parliament and all the MLAs of Delhi ) but no action has been taken so far. Our demands are :

  1. Declare 89 villages as “urban” villages and 95 villages as development areas at the earliest (This matter is lying pending with the Government of NCT Delhi for the last 17 months) .

  1. Relex the provision in respect of fragmented land. The land may be returned to Farmers to the nearest to the actual land and to DE in vicinity of the largest land holding within the same zone, as far as possible.



  1. There is proposal to shift the big markets from Old Delhi to NCR.  We demand that preferences should be give to these (proposed) urbanised villages under Land Pooling Policy.


The Federation of Housing Societies & Developers in Delhi ( Land Pooling Policy) and Delhi Dehat Vikas Manch (jointly) have resolved that the Delhi Government and DDA should finalize the Land Pooling Policy in public interest, at the earliest.
